Duty to cooperate

Judges, when determining if damages could be claimed against public bodies, do not restrict themselves to the duties owed by the department in which the lead professional worked, but rather consider what duties and powers were owed by any relevant public body, given what was known or ought to have been known of the risks or needs in any particular case. It is therefore vital that practitioners inform themselves of the wider duties owed within the safeguarding context, including from other disciplines. Practitioners should never assume that another professional has a duty or power to act to prevent or stop abuse. Instead they must explore what powers might be available, whether there are any restrictions that apply in that case on using those powers, and challenge, when necessary, to secure cooperation from relevant partner agencies where there is a reasonable cause to suspect an adult is at risk.
